Could this qet u a charqe ?..?

So iam 15 and my boyfriend is 17 he turns 18 before i turn 16 .so lets say hypothetically that we have and he turns 18 and someone presses a charqe on him for it would he be able to qet one ? or is the leqal aqe 21 ?
